Terms & Conditions
Please read these terms carefully before using our services.
1. Agreement to Terms
By accessing and using this website and services provided by Dupuis Custom Bracing ("Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
2. Use of Services
Permitted Use
Custom Bracing services are provided for personal, non-commercial use only. Our services include consultation, assessment, custom bracing fitting, and related support for orthopaedic and medical applications. By using our services, you agree to use them lawfully and in compliance with all applicable regulations.
Medical Products
Custom braces and medical products are prescribed or recommended based on individual assessment. These products are medical devices and must be used as directed by our certified fitters and your healthcare provider. Improper use may result in injury or reduced effectiveness. We are not responsible for misuse or failure to follow care instructions.
Age Requirement
You must be at least 18 years of age to enter into a service agreement with us. Minors must have parental or guardian consent.
3. Appointments & Cancellation
Appointments must be scheduled by phone or email. We request a minimum of 48 hours notice for cancellations. Cancellations made with less notice may incur a consultation fee. No-shows without notice are subject to a scheduling fee of up to 50% of the appointment value. Rescheduled appointments are subject to the same cancellation policy.
4. Pricing & Payment
Custom Solutions
Pricing for custom bracing and medical products is determined during your consultation based on your specific needs, the products selected, and fitting requirements. We do not publish standardized pricing because each solution is customized. Pricing is provided before services are rendered.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made. We accept cash, debit, credit card, and electronic transfer. For insurance claims, we will bill your insurer directly when pre-approval has been obtained. You remain responsible for any amounts not covered by insurance.
Insurance Billing
As a preferred provider with most major insurers, we will bill WSIB and ODSP directly when applicable. For private insurance, we recommend pre-submitting your claim to confirm coverage. You are responsible for understanding your insurance coverage and co-payments. Disputed claims or delayed reimbursements remain your responsibility.
5. Product Warranty & Returns
Manufacturer Warranty
All products manufactured by Össur® and other brands come with their respective manufacturer warranties. These warranties cover manufacturing defects but do not cover normal wear, misuse, modification, or damage resulting from improper care or use. We will facilitate warranty claims with manufacturers on your behalf.
Return Policy
Custom-fitted braces and products are non-refundable once fitted or used, as they are tailored to your individual specifications. If a product does not meet your needs immediately after fitting, we offer a 7-day consultation period during which adjustments or exchanges may be considered at our discretion. No refunds will be issued after this period.
Care Instructions
Proper care and maintenance are essential for product longevity. All customers receive detailed care instructions upon fitting. Failure to follow care instructions may void product warranties and manufacturer coverage.
6. Limitation of Liability
Custom Bracing provides services in good faith based on your individual assessment and needs. However, we do not guarantee specific outcomes or results. Medical outcomes depend on many factors beyond our control, including proper use, adherence to care instructions, underlying health conditions, and compliance with healthcare provider recommendations.
To the fullest extent permitted by law, Custom Bracing is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, or business opportunity
- Personal injury or medical complications (except where caused by our negligence)
- Misuse, improper fitting by the customer, or failure to follow care instructions
- Damage to products due to accident, misuse, or improper maintenance
7. Medical Disclaimer
Custom Bracing fitters are certified orthotists/prosthetists and not physicians. Our recommendations are based on assessment and industry best practices, but we do not provide medical diagnosis or treatment. You should always consult with your physician or healthcare provider regarding your medical condition and the appropriateness of any brace or medical product for your specific situation. We strongly encourage open communication between you, your healthcare provider, and our team.
